Afghan worker in Australia wins $2m in compensation

Afghan worker in Australia wins $2m in compensation

Feb 06, 2018 - 10:00

KABUL (Pajhwok): An Afghan refugee living in Australia has won nearly $2 million in compensation after he suffered a back injury, a news report says.

Rahmatullah Baig injured his back working at a meat factory in July 2010 -- just a month after starting work. The injury left him unable to do manual work.

With his slipped disk blamed on employer's negligence, Baig sued Teys Australia Central Queensland and labour hire firm AWX in the Rockhampton Supreme Court.

The man from the minority Hazara community found his way to Australia in 2009 by boat, Daily Mail reported.

After spending some days in jail, Baig reached Rockhampton in Central Queensland and worked in the abattoir for over a month before the injury.

While moving a bull carcass on an assembly line to the point where he was almost horizontal, he felt pain in his back, the report added.

Diagnosed with an L5/S1 disc prolapse, where the vertebrae ruptures and the soft inner gel leaks out, he was given a 10 per cent impairment.

However, an orthopedic surgeon said manual labour would worsen his condition. “Repetitive bending or heavy lifting, especially if associated with twisting, is likely to make pain worse...”

In a ruling on his petition, Justice Duncan McMeekin said: “He has difficulties sitting or standing for significant periods, difficulties walking when the condition was at its worst.”
